Incoterms, or International Commercial Terms, are a set of contract terms for international freight delivery. While the word itself creates some mystique, they are in fact simple - entirely concerned with the delivery of goods, especially in an international environment.

Our Incoterms expert David Lowe, who is also global co-chair of the Incoterms 2020 drafting group, gives an overview here of these important contract terms and how to use them to best effect.

In July 2018 the UK Financial Conduct Authority (FCA) published its near-final rules on extending the senior managers and certification regime (SMCR) to all firms regulated by the FCA.

With SMCR now on the horizon, both employers and employees within regulated firms will need to understand how it will affect them. Hosted by our financial services and employment experts, this podcast will discuss:
  • clarifying how the SMCR applies to different tiers of firms;
  • the new categories of senior management functions;
  • the new requirements relating to statement of responsibilities, the responsibilities map, the certification regime, the conduct rules and the prescribed responsibilities;
  • the new training requirements; and
  • the transitional provisions.

We will also discuss employment-related issues in the context of the SMCR and aligning human resource processes with the SMCR. This includes reviewing and updating employment contracts and employee handbooks and incorporating fitness and propriety assessments into annual employee reviews.

In our recent report Protectionism 2.0: Digital forces driving the new protectionist agenda we highlighted how measures restricting data flows crucial to businesses pose as much a threat to international trade as cruder, traditional tools of trade protectionism.

There is widespread consensus that the World Trade Organisation ("WTO") needs modernisation in order to tackle the challenges presented to free trade by both traditional and digital protectionism. Such reform is being considered against a backdrop of concern as to the viability of the WTO dispute resolution process and the use of such practices as forced technology transfers. In the UK, the WTO is now attracting attention as a 'fall back' proposition, should there be a 'no deal' Brexit.

We aim to bring you up to speed with the latest developments in this area; we consider possible outcomes for the rules-based multi-lateral trading system and time table of reform; addressing in particular the proposals for WTO reform put forth by the EU and its allies on 26th November. In what seems at times a polarised world, we explore the likelihood of emergence of a consensus between players as diverse as China and the US.

To build on the findings from our whitepaper Protectionism 2.0: Digital forces driving the new protectionist agenda, our latest podcast sees Gowling WLG's Ursula Johnston and Sean Giles talk to national journalist Andrew Cave, a previous writer for the Daily Telegraph and Forbes magazine. The podcast explores the crucial customs and border issues that are likely to be caused by protectionist laws and barriers that govern the movement of data, as well as tech related goods and services.

The podcast will consider:

  • The practical and realistic implications of these laws and the protectionist approach
  • The issues that this will create where the accelerated race to develop smart tech is concerned

The entire product development process – from mining and manufacturing to product development – and the individual concerns that protectionism creates for these.
